I attest that my organization has processes in place to validate that downstream third parties maintain effective compliance programs, such as: 1) Maintenance of Codes of Conduct and policies/procedures, that are updated annually, and shared with employees within 90 days of hire and annually afterward. 2) Completion of Compliance and FWA training, as required (for FTEs only). 3) Completion of exclusion-screening checks of all employees and third parties prior to hire/contracting and monthly afterwards (for FTEs only). 4) Establishment of effective methods to monitor for regulatory changes and to ensure prompt and accurate implementation of changes to systems and processes. 5) Maintenance of accurate records of their compliance program as well as anything pertaining to the work they do for Premera for a period of ten years. 6) Not employing marketing practices or benefit design changes that will have the effect of discouraging the enrollment of individuals with significant health needs, where applicable. 7) Compliance with applicable state and federal nondiscrimination laws/regulations, including, but not limited to Section 1557 of the Affordable Care Act and Sections 504 and 508 of the rehabilitation Act of 1973, as amended in 1998. 8) Not discriminating on the basis of race, color, national origin, disability, age, health status, degree of medical dependence or quality of life, sex gender identity or sexual orientation. 9) Preparation for a government regulator, or their designee, to inspect, evaluate and audit any pertinent contracts, documents and records involving the services performed for Premera. 10) Retention and destruction of documentation related to work performed for Premera in accordance with applicable laws regulations and the contract with Premera. 11) Maintenance of a program to assess the business continuity and disaster capabilities related to the Premera agreement.
